Laws, decrees, orders and other normative legal acts adopted in 2022 on SMEs and startups in Azerbaijan

• The President of the Republic of Azerbaijan approved the law dated February 9, 2022 "On Amendments to the Law on Suspension of Inspections in the Field of Entrepreneurship". According to the law, inspections conducted in the field of entrepreneurship in the territory of the Republic of Azerbaijan will be suspended for another year, is stopped until January 1, 2023. 
• The new Law on Enterprises, which will enter into force at the end of 2022, is designed to expand the financing and development tools of the startup sector, innovation and technology industry, and to involve the private sector in these processes. The capital of the new fund is 11.3 million manats and was formed at the expense of equity investments of five million each of the two co-founders, including 1.3 million manats provided by several private investors. Based on the analysis of the incubation and acceleration programs implemented in the country, it is planned that the Fund will invest in about 150 local and regional startups in the next 7 years. Priority is given to innovative areas in the finance, education and agriculture sectors, as well as cloud technologies, retail, e-commerce and the gaming industry.
• The removal of the words "state fee and other" from paragraph 7.5 of the "Charter of the Small and Medium Business Development Agency of the Republic of Azerbaijan" of the President of the Republic of Azerbaijan on April 5, 2022 was approved.

  DECISION OF THE CABINET OF THE REPUBLIC OF AZERBAIJAN

  According to paragraph 5.10 of the Decree No. 1464 of the President of the Republic of Azerbaijan dated October 11, 2021 "On some measures related to the improvement of management in the field of digitization, innovation, high technologies and communication in the Republic of Azerbaijan", the Cabinet of Ministers of the Republic of Azerbaijan decides:

  1. Resolution of the Cabinet of Ministers of the Republic of Azerbaijan No. 292 dated July 12, 2018 "On approving the list of subordinate institutions not included in the structure of the Ministry of Digital Development and Transport of the Republic of Azerbaijan" and canceling some decisions of the Cabinet of Ministers of the Republic of Azerbaijan (Legislative Collection of the Republic of Azerbaijan , 2018, No. 7 (Book II), Article 1626; 2021, No. 11, Article 1276; 2022, No. 4, Article 425, No. 5, Article 555, No. 9, Article 1092, No. 10, Article 1226) the following changes should be made :

  1.1. Add part 3 as follows:

  "3. Amendments to this Decision can be made in accordance with clause 2.6-1 of the "Regulation on the Procedure for the Preparation and Adoption of Normative Legal Acts of Executive Power Bodies" approved by Decree No. 772 of the President of the Republic of Azerbaijan dated August 24, 2002.";

  1.2. According to the "List of subordinate institutions not included in the structure of the Ministry of Digital Development and Transport of the Republic of Azerbaijan" approved by that Decision:

  1.2.1. The 11th and 13th parts should be given in the following redaction:

  "11. "Innovation and Digital Development Agency" public legal entity.

  13. "Information Communication Technologies Agency" public legal entity.";

  1.2.2. Sections 4, 14 and "Note" should be deleted.

  2. "Regulations for maintaining an open register of innovative projects for the public and issuing a "Startup" passport" approved by Resolution No. 21 of the Cabinet of Ministers of the Republic of Azerbaijan dated January 29, 2021 (Legislative Collection of the Republic of Azerbaijan, 2021, No. 1, Article 104) In paragraph 2.1, the words "Innovations under the Ministry of Transport, Communications and High Technologies" should be replaced by the words "Innovation and Digital Development under the Ministry of Digital Development and Transport".

  3. Resolution No. 382 of the Cabinet of Ministers of the Republic of Azerbaijan dated December 3, 2014 "On approval of the Charter and structure of the "National Nuclear Research Center" Closed Joint Stock Company (Legislative Collection of the Republic of Azerbaijan, 2014, No. 12, Article 1660; 2016, No. 3 , Article 585; 2019, No. 4, Article 756, No. 5, Article 948; 2020, No. 5, Article 653) should be repealed.
